“Landlords, Property Managers Fined for Violations of Lead Paint Disclosure Regulations”

The U.S. EPA, Region 7, has issued 13 civil complaints with proposed penalties totaling $159,400 against landlords and property management companies in Missouri and Nebraska for failing to disclose information to their tenants on lead-based paint hazards in housing built before 1978. The disclosures are required by the Real Estate Notification and Disclosure Rule. The rule is a public right-to-know initiative under the Residential Lead-Based Paint Hazard Reduction Act.

The Disclosure Rule requires landlords, sellers, and real estate agents to provide prospective tenants and purchasers information about lead-based paint hazards. The regulation also requires that leasing and sales contracts include certain notification and acknowledgment language.
