New disability legislation removes small employer exemption in UK

The small employer exemption under the Disability Discrimination Act will be removed under proposed EU discrimination laws, according to the February issue of Facilities Management Legal Update. Currently, organizations that employ fewer than fifteen employees are not required to comply with the Disability Discrimination Act 1995 (DDA).

The DDA imposes duties on employers, trade organizations, service providers, and owners and managers of property not to discriminate against disabled people. Beginning October 1, 2004 there will be an additional duty to make physical adjustments to premises, where it is reasonable to do so, to enable disabled persons to use the service.
