Even though the AB651 telecommunications/forced access legislation was stalled for a year in California, recently approved new amendments have revived it. The bill was originally written because telecommunications companies filed formal complaints claiming that they were denied unrestricted access to a building. The bill was stalled in the Senate by the opposition of Senator John Burton (D), Senate President Pro Tem. The newly amended version would permit building owner to prohibit a telecom provider access rights. However, if the owner/tenant requests service, the owner cannot charge a fee from the service provider. BOMA California states that it is maintaining “heavy opposition against the bill,” and adds that final outcome is still uncertain.
