Theater Wins Appeal on ADA Violation

The 5th Circuit U.S. Court of Appeals ruled in favor of Cinemark on April 6, reversing the district court holding. The Court of Appeals decided that the theater did not violate the Americans with Disabilities Act (ADA), but did, indeed, provide patrons in wheelchairs with lines of sight comparable to those of the general public. The question was whether the “line of sight” clause means that theater owners are required to provide the same viewing angle for both disabled and non-disabled patrons. The court’s opinion was that the ADA requires only an unobstructed view.
